=terms and conditions image These conditions and the contract are stated in accordance with English law including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCR), the Consumer Protection (Amendment) Regulations 2014, the Consumer Rights Act 2015 and the Electronic Commerce (EC Directive) Regulations 2002.
Alloywheelsdirect.net, alloywheelsdirect.com and the eBay ID "alloywheelsdirectltd" (referred to as 'the site') is owned and operated by Alloy Wheels Direct Ltd (referred to as 'us/we/our'). Users of this site and our eBay shop (referred as 'you/your') acknowledge that this use, including any downloading of information/images and placing an order is subject to our terms and conditions (referred to as 'T&C') as stated below. Please be advised to read these terms and conditions before using the site.

Section 1. General

a. These T&C are subject to change. Changes take effect when published on our site in this section. It is your responsibility to ensure that you have read the latest T&C each time you visit the site
b. Users only use the site for the purpose for which it is intended, the display of information and goods for sale
c. Advice we give verbally does not form part of any contract between you and us

Section 2. Ordering

a. Orders placed via the site are accepted subject to these terms and conditions. When ordering online you are deemed to have completed the checkout process and acknowledged that you have read and understoood these T&C
b. We will send you via email an order acknowledgement containing details of the products you have ordered. This will allow you to check that the details submitted to us are correct
c. Our acceptance of your order takes place upon despatch, collection or when tyres are fitted to wheels, whichever is soonest. When we despatch your order, the contract of sale is transmitted to you via an attached email document
d. We reserve the right to decline your order or seek further information before we accept your order. We may decline your order in these circumstances:

  • the goods are no longer available or cannot be supplied within a reasonable timescale
  • your payment fails our anti-fraud measures listed in section 8
  • there has been a pricing error such that it is not viable to supply your order
  • we cannot despatch to your requested delivery address
  • you do not satisfy the eligibility criteria set out in these T&C

d. All orders containing wheels or tyres are accepted on a special order basis and we purchase from our suppliers to fulfil your order
e. We aim to despatch your order according to the timescales shown on our website product pages. If we are informed from our supplier that there will be delay in us receiving the goods for your order then we will communicate this to you.

Section 3. Payment & Pricing

a. Card payments processed through SagePay are classified as "deferred"; at the time you submit your order to us, your card issuer authorises the transaction and reserves the funds for the transaction until such time as we "release" that hold and the payment is cleared through our card acquiring bank. Your Payment is usually released soon before the despatch of your order
b. PayPal transactions are released within the 2-3 days that their system allows before it cancels the hold
c. The price you pay will be confirmed at the time of payment. We endeavour to ensure that all prices given to UK and EU consumers via email and telephone are inclusive of the applicable VAT rate. Our website will display prices either with or without VAT depending on the status of the toggle at the top left of the page. To ensure you view correct pricing, please select your country using the box at the top of the website
d. We have systems in place to ensure the accuracy of the prices shown on the site. Should we make an error, we will inform you before we process your payment and give you the choice to cancel or pay an additional amount that makes your order viable for us to accept
e. Title to the products you have purchased pass to you upon delivery provided full payment has been processed and received. Should your credit card payment be charged back, title is passed to us and we will take steps to recover our goods

Section 4. Delivery and Inspection of Goods

a. If any product delivered to you has damaged packaging or for other reasons looks as though it may have been damaged in transit, you should sign for the package as 'not inspected' and subsequently carefully examine the contents
b. Upon receipt of the goods, the customer is required to personally inspect the goods within 3 days for any damage or defects and report this to us. Damage reported after 3 days will not be accepted as a return
c. We advise you not to fit any product that looks damaged in any way. If you identify any damage or issues, please report this to us within 3 days of delivery
d. Do not pass the goods to a third-party (eg tyre fitter, garage, wheel shop, mechanic) until you have personally inspected and approved their condition. Any damage reported after transfer to a third party will be the responsibility of the customer, and we will not be held liable for such damages
e. Liability for loss or damage passes to you at the time they come into the physical possession of either you or the person you have asked us to deliver to. If you have an agreement with UPS under the "My Choice" service then please be aware that your instructions to them may include leaving the package(s) at your authorised location. Delivery according to your instructions constitutes possession by you and subsequent loss or theft from that place is your responsibility
f. We advise that you test fit wheels for clearances before fitting tyres, and test fit complete wheel and tyre units before driving the vehicle. This can be done by offering up the wheel to the vehicle hub and does not require bolts being inserted into the wheels (which would leave the wheels marked inside the bolt holes

Section 5. Withdrawal, Cancellation & Returns

b. If we have not despatched your order, you can withdraw from your order by calling or emailing us quoting your order number. Withdrawal is possible unless excepted by a condition stated in section 5e below
c. If we have despatched your order but it has not yet arrived, you can cancel your order by calling or emailing us. Cancellation is possible unless excepted by a condition stated in section 5e below. We will advise whether to accept the delivery or to reject it depending on the exact circumstances and the contents of your order
d. If you have received your order, you must advise us of your wish to cancel within 14 days starting the day after the day on which the goods come into the physcial possession of either you or the person you have asked us to deliver to. The return address is:

Under certain circumstances we may provide a return address within the United Kingdom
e. Your right to withdraw, cancel or return goods as per CCR will apply unless in the following circumstances.

i. you have purchased as a business and do not qualify for consumer protection
ii. where the sale was concluded by means of auction (eg eBay listing)
iii. where the products have been manufactured to your individual requirement or supplied on a special order basis. **Almost all products we offer are non-stock and are purchased from our suppliers to fulfil your order on a "special order" basis. If you order tyres with wheels then the combining of these non-stock parts constitutes goods being made to your individual requirement.** Please consider your purchase carefully to avoid a costly return or cancellation request. Contact us to ask if the products you wish to order are special order items
iv. if we have not despatched your order, or not yet combined wheels with tyres, withdrawal from your order is without penalty unless our supplier imposes a restocking charge or refuses our request to return the products to them. Please contact us as soon as possible so that we can work with you to minimise these costs. A cancellation fee equivalent to 20% of your order will be charged in the instance where our supplier refuses our return request.
v. if we have despatched your order and it does not contain tyres fitted to wheels, cancellation of your order is without penalty unless our supplier imposes a restocking charge or refuses our request to return the products to them. Please contact us as soon as possible so that we can work with you to minimise these costs. A cancellation fee equivalent to 20% of your order will be charged in the instance where our supplier refuses our return request.
vi. if your order has not yet been despatched, but tyres have been fitted to wheels, a cancellation fee is applied equivalent to 25% of the combined sales total of the wheels and tyres
vii. the product has been used or fitted. eg fitting tyres to wheels we supply, or fitting complete wheels to a vehicle. We may still accept a return but would make an appropriate deduction for diminished value of between 25% and 40%
viii. the products are not returned to us in the same condition in which they were delivered. We may still accept a return but would make an appropriate deduction for diminished value of between 25% and 40%

We may at our discretion still allow withdrawal/cancellation/return with or without a contribution to our costs. It depends on the restocking charges from our supplier, whether tyres have been fitted, and whether you intend to order alternative products from us

f. Goods must be returned in the original packaging in which they were sent. The packaging for wheels with or without tyres is critical to keeping them safe from damage during transit. It is your responsibility to ensure that that this is done
g. Return delivery is at your expense although we can arrange for collection and deduct the direct cost of this service from the refund amount. The return shipping cost to us will always exceed the initial cost of delivering the goods to you by the nature of UPS import shipment charges. If the goods are faulty or otherwise not fit for purpose then we will pay for the return delivery charge
h. If in the unlikely event that the wheels supplied are not suitable for your car, we will not credit you for any 3rd party fitting charges

Section 6. Intellectual Property

a. You agree that the content of this website including all copyright material, trademarks and other intellectual property made available to you while using this site remain vested in us and our licensors
b. You acknowledge to use the site on the basis that the material contained within is for your personal non-commercial use and that you may only download such materials to facilitate this aim. Any other use of the material contained within this site is strictly prohibited and you agree not to (and agree not to help any third party) to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content

Section 7. Liability and Indemnity

a. These T&C do not limit liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not be limited or excluded under the applicable UK law
b. Subject to Section 7a above, we will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and we accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site
c. Any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under the applicable law
d. Subject to 7a, we will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
i) economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings);
ii) or loss of goodwill or reputation;
iii) or special or indirect losses
suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions
e. Notwithstanding the above, subject to Section 6a we aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same cause
f. This clause 6a does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights
g. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you

Section 8. Anti-Fraud measures

We take fraud seriously and will report to the appropriate authority any attempt to defraud us. To ensure that online shopping is safe for all our customers, we use various methods to ensure that all payments we receive are genuine. We use various methods depending on the payment type, as follows:

a. Deko - Deko incorporate various anti-fraud measures into their application process. You may be asked to upload a scan of your driving licence or passport to complete the process. We will always send your goods to the address used in the Deko application process

b. PayPal - We only accept payments that have been assigned "Eligible" status for PayPal's Seller Protection Programme. We will always send to the address on the PayPal payment. You can ensure your payment is eligible by completing as many steps of the PayPal verification process as you can for your country

c. Card payment through SagePay - The main tool we use to protect our revenue and eliminate plastic card fraud for CNP (customer not present) card transactions is called The Third Man. They automatically score each transaction based on various criteria and if a threshold is passed, the order is checked by a human who makes a recommendation as to whether we should accept the order. The quality of this service is very good and genuine customers should not be concerned of their transaction being flagged as potentially fraudulent. You can ensure your order passes without the delay of manual checking by: 

  • Requesting delivery to the address at which you receive your card statements
  • Completing the 3D verification service when submitting your card payment; Verified by Visa, Mastercard SecureCode, American Express SafeKey
  • Inputting a landline telephone number as your home telephone number at checkout
  • Using an email address that contains your name in some way

d. Bank Transfers & Branch Deposits - we are happy to ship to any address you like if you wish to pay by bank transfer

Section 9. Miscellaneous

a. The contract between you and us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England
b. English is the only language offered for the conclusion of the contract
c. Our products are offered for sale for domestic use only, if you are planning to use them for business or commercial purposes please ensure you have adequate insurance cover
d. We shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these T&C if the same is wholly or partly caused whether directly or indirectly by circumstances beyond our reasonable control
e. To provide increased value to our customers, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (1) the privacy practices of such websites, (2) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (3) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources
f. You may not assign or sub-contract any of your rights or obligations under these T&C or any related order for products to any third party unless we have previously agreed upon in writing
g. We reserve the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of our rights or obligations under these terms and conditions or any related contract to any third party
h. If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected
j. These terms and conditions do not create or confer any rights or benefits enforceable by any person that is not a party (within the meaning of the U.K. Contracts (Rights of Third Parties) Act 1999) except:
i) Alloy Wheels Direct Ltd shall have the right to enforce any rights or benefits under these terms and conditions;
ii) Alloy Wheels Direct Ltd shall have the right to enforce and take the benefit of the rights or benefits of any limitation or exclusion or limitation of liability in these terms and conditions;
iii) a person who is a permitted successor or assignee under this section of the rights or benefits of these terms and conditions may enforce such rights or benefits
iv) No consent from the persons referred to in 8k is required for the parties to vary or rescind these terms and conditions (whether or not in any way that varies or extinguishes rights or benefits in favour of such third parties)
k. No delay or failure by us to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by our authorised representative
l. These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and us relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and us for your use of this website
